Terms and Conditions

General

The present Terms & Conditions of Sale apply exclusively between GOLAY Pte Ltd (further on "Us"), and any person visiting or buying via the site golaysingapore.com (further on "you").

These Terms & Conditions of Sale can be modified at any time; the conditions applying are the one in force at the date the order was placed. You declare being aged of at least 18 years old and having the legal capacity or a parental authorization that allows you to place an order on the site.

Order Confirmation

After having placed your order, you receive an e-mail that confirms the elements of your order and that informs you about the availability, the shipment mode and expected delivery time. This electronic mail forms thus the sale contract between You and Us. If for a reason independent of our will, one or more articles could not be delivered within the times indicated, we would send you a new e-mail to keep you informed about the new expected date of availability of the out-of-stock item(s).

Payment

Prices displayed on the website are quoted in Singapore Dollar (SGD) include GST 7%. Customers from Malaysia can see prices in MYR whereas customers from other countries can see prices in USD, both of them shown without taxes.

Payment can be made by secure PayPal and Stripe payment systems. Singapore payments can also be made by bank transfer (bank account details will be shown on your order confirmation email) or PAYNOW (UEN 198004213W).

Except for delivery in Singapore, where the computer system automatically includes the GST when ordering online, payment of any GST/VAT taxes and customs duties applicable in the country where GOLAY Pte Ltd sends the product must be paid by the purchaser. Any order placed on the website golaysingapore.com cannot be cancelled, in no case whatsoever, once the products are sent.

Shipping

Models available on stock are usually shipped within 3 to 5 working days upon receipt of payment. Upon shipment, delivery time is approximately 1-3 working days within Singapore and 3 to 5 working days outside Singapore. Shipments in Singapore are arranged via a local courier company (Speedpost, XDel, etc.)

Shipments outside Singapore are arranged via international courier company with tracking and signature.

Delivery

Delivery and billing address

Products are delivered to the address specified by the customer on the order form. The customer may, upon request, have the invoice sent to the billing address and not the delivery address by validating the option provided for this purpose on the order form.

Delivery problems due to carrier

The customer is responsible for verifying the condition of the product packaging upon delivery and for indicating any damage to the carrier on the delivery note, as well as to GOLAY Pte Ltd. Any anomaly concerning delivery (damages, delivery-related missing products, damaged package and products) must be indicated upon receipt imperatively. In case of damage, the customer must inform the carrier not later than the first business day following the date of delivery.

Delivery errors

The customer must address to us on the same day of delivery or, at the latest, one working day following delivery, any claim of delivery errors and/or non-conformity of products in nature or in quality compared to indications listed on the order. All claims made beyond this time limit cannot be accepted. Such claims can be made to us via our website under the "Contact us" form.

Delivery time

When products parts are in stock, delivery time can be estimated to approximately up to 10 working days (except in cases of force majeure, transport strikes, etc.). Orders cannot be handled on weekends or public holidays. Deliveries cannot be made on weekends or public holidays.

Order Tracking

As soon as we start processing your order we will send you an email with the delivery information. Upon shipment of your order, you will receive a notification with a Courier or FedEx tracking number.

Taxes

Prices in SGD for orders to be delivered in Singapore are inclusive of GST 7%. Orders placed on golaysingapore.com in MYR/USD for delivery outside Singapore could be subject to possible taxes and customs duties that are imposed when the parcel reaches destination. These customs duties and possible taxes applicable to a product are at your charge and under your own responsibility. We thus recommend you to contact your respective country tax and customs authorities for information.

Product & Quality

We do our best to provide accurate product descriptions. We also make every effort to ensure that each photo on our website accurately represents a pearl type in size and colour. However, all pearls are unique and accordingly it is possible that products purchased by you may vary slightly from the relevant description or photo we provided. We give a guideline for ring sizing; nevertheless, we cannot take responsibility for variances between different sizing methods and standards.

Returns

By accepting our Terms & Conditions of sale you agree on the applicable procedure of returns in the event of delivery of an article not in conformity with your order or damaged during transport. To be accepted, any return will have to be preliminarily announced to our Customer Service via our “Contact Us” form for obtaining return shipment instructions. Returns can be accepted only for articles delivered which are not in conformity either in nature or quality as stated under Delivery errors. To be accepted and processed, any return will have to be prior announced to our Customer Service via our “Contact Us” form. We will then provide you with a “Return approval code” and the corresponding return shipment instructions.

Items may be exchanged or returned for refund within 10 days of delivery. Items must be returned in their original packaging with all accessories, instruction manual, warranty cards, shipping documents and invoice.

Returned items due to non-conformity in kind (wrong model) or quality (damaged, non-functioning) will be replaced. In the event that an article is out of stock or discontinued, or that an alternative model proposed is not acceptable to the customer and thus cannot be replaced, its value will be refunded to the buyer.

Any returned item with signs of wear and tear through use, will not be accepted. Return shipment expenses for non-conform items are borne by GOLAY Pte Ltd.

Risk and Property

Risk of damage to or loss of the Goods shall pass to the Buyer at the time of delivery or if the Buyer wrongfully fails to take delivery of the Goods, the time when GOLAY Pte Ltd has tendered delivery of the Goods. Notwithstanding delivery and the passing of risk in the Goods or any other provision of these Conditions the property in the Goods shall not pass to the Buyer until Golay Pte Ltd has received full and cleared payment of the price of the Goods

Guarantee and responsibility

Provisions of responsibility

We are committed to take all the care to ensure an impeccable service to our customers in line with our Terms & Conditions of Sales. Nevertheless, we cannot be held responsible for any unforeseen and involuntary delay or non-conform delivery due to an out-of-stock condition from our manufacturer.

Moreover, minor differences between the photographs, text and description of the products on the website and the actual product may occur for which our responsibility is not engaged.

Provisions of the guarantee of products

GOLAY Pearls are delivered with a certificate of authenticity.

Reuge musical instruments enjoy a 2 years international warranty.

We commit to replace the possible defective products provided malfunction has not been caused by mishandling or wrong manipulation from the customer. Defective products that can be replaced or repaired will not be refunded. If a model cannot be repaired or is not available for replacement, GOLAY Pte Ltd reserves the right to propose an alternative and similar model of the same or higher value.

In the event of request for repair of a product whose guarantee has expired, the prices charged will be those applicable at the time of the request. A preliminary estimate can be requested from the manufacturer at a cost of SGD 100.- (or equivalent in other currencies), deductible from the invoice if the repair is carried out. Should the repair not be carried out, the product will be returned at customer expenses unless otherwise instructed by the customer.

Governing Law and Jurisdiction

These general conditions of sale are subject to Singapore law. All disputes relating to the commercial relationship between You and Us are subject to the jurisdiction of the Republic of Singapore.
